The email industry is under a prolonged and targeted attack. Going back almost a year now, service providers and their clients have been the focus of so-called spear-phishing (targeted phishing) and other intrusions that have resulted in large-scale direct and indirect data breaches. It's scary stuff, and the worst of it is far from over.

Largely, these breaches have come in two flavors: system intrusion with direct compromise of data (Return Path, Silverpop and others) and client credential compromise (CheetahMail), whereby a bad actor gains control of a valid and trusted user account at an email service provider (ESP) and uses it to send malicious content.

The case of a compromised client system (penetrated from the outside or perpetrated from within) is a particularly vexing one for service providers. You'll hear a lot of the discussion about what companies should do to prevent system and account credential compromise -- from better role-based access control and bi-directional client/service provider agreements to multi-factor authentication and external penetration testing. This article isn't about those things. It's about what to do when your best-laid plans for how to prevent a compromise fail, as they inevitably will.

Gonna Happen

The hard reality is that regardless of the steps taken to prevent it, a compromise will eventually happen if you've got the customer data that a motivated bad actor wants. There are simply too many human, business process and technical points of vulnerability to prevent it. Given this reality, organizations need to not only invest in trying to prevent compromises, but also in detecting them when they happen and in the strong remediation steps to mitigate the damage when they do. This is the core of the "defense in depth" concept: all systems should have multiple layers of protection in place, so when one inevitably fails, there are backups further down the stack to prevent or limit the damage.

Why is all this important? If not having your breaches broadcast on Twitter and headlined in The Wall Street Journal aren't motivation enough, it's that allowing compromised accounts to run rampant in your infrastructure fundamentally damages your business, the trust your clients put in you, and the reputation you've worked hard to establish with end users and mail providers. We have a duty and obligation to protect our clients from themselves and those around them, and we have a fundamental responsibility for the quality of any messaging that comes from our systems.

So what can be done? One of the common techniques that is implemented today (or at least recommended) is to automatically pre-scan a campaign with a content scanner, such as SpamAssassin, before it's sent out. This technique suffers from a number of shortcomings:

High false positive rate, since marketers are always pushing the envelope on content, and SpamAssassin makes heavy use of heuristic content-based detection.
Timing issues, especially when catching so-called zero-hour attacks. If your system is the origination point for a new piece of malware or a new phishing URL, feedback-based systems won't have yet seen the attack to build the rule to catch it.
Clever use of dynamic content can make a test sample message appear completely benign while the live campaign contains the malicious content.

Look at the Stream

Because content and reputation can change in real time, the only truly effective way to monitor a live system is by monitoring both behavior heuristics and the live stream of mail that you're deploying in real time.

From a behavior heuristics standpoint, there are a number of things that can be monitored in real time:

Feedback Loop (FBL) complaint rates -- particularly sudden spikes and deviations from the norm
An unexpected jump in "invalid recipient" bounces or other undeliverable messages
A spike in messages to domains which haven't been sent to previously

The critical point here is that you need to track these factors in real time and make your decisions in real time -- like suspending a client's mailing and dispatching your security team to investigate.

While heuristic methods are great, there's no substitute for direct observational techniques. You can and should monitor your live outbound mail stream itself and make decisions based on that. You can spot abuse in your mail stream by looking for the presence of the following:

Spam, phishing or malicious URLs in a message, based off a lookup against one or more of the SURBL lists or another URIBL.
Malicious or abusive content, based off the verdict of a commercial or non-commercial anti-spam/anti-virus scanner.

While the cost overhead (in terms of licensing costs and/or processing overhead) for scanning all of your mail with these techniques can be high, they don't need to be applied with a global simple on/off.

For messages that support completely unique, user-supplied content, scanning every message is the only way to be reasonably safe. (Examples are a forward-to-a-friend service where an end-user can supply content for the message, or a jobs site where an end-user can send a resume through your mail system.) These are well-known and commonly abused vectors and can be sending out malicious content even when no compromise has occurred.

What to Do About It

For campaign-based mailings, though, you can take an approach similar to many network security systems and employ stratified random sampling to continuously monitor a portion of every unique campaign that leaves your system. This technique ensures that every campaign gets monitored and real time reputation data can be effectively used while limiting your license and overhead costs.

Once you've identified a suspicious mail stream or campaign, there's a variety of things you can do with that information. One already mentioned is to suspend that campaign (or all of a client's campaigns) and alert your security experts. Of course, you can also push this information directly to a contact at your client company for investigation on their side.

However you choose to handle what you find, everything starts with your ability to detect a compromise in the first place. Again, real time detection that facilitates real time decision-making is the key. Things are happening too fast and the potential damage is too great for any other solution to suffice. So find the right combination of technologies and applications that will ensure a safe and secure messaging environment for you, your clients and their customers' data. Do everything you can to harden your defenses to prevent a breach, but be prepared for the inevitable breach when it occurs.

Who benefits most from weight-loss TV shows?

LOS ANGELES (AP) ? Despite all the ?Biggest Loser?-type shows on TV, all the pounds shed by their contestants and all the weight-loss products purchased by viewers, America continues to be the Biggest Gainer.

At least 10 weight-loss shows are airing these days, and on ?The Biggest Loser? alone, this season?s three top finalists dropped a combined 365 pounds. Yet the rest of us are just getting chubbier, with obesity rates in the United States now the highest of any industrialized nation. In fact, more people are obese today than when ?Loser? premiered in 2004.

So why aren?t these reality shows helping in the fat fight?

JD Roth, executive producer of ?Extreme Makeover: Weight Loss Edition,? thinks they actually are.

?The first step to changing some systemic problem in society is awareness and I think (weight) awareness is at an all-time high,? says the 43-year-old producer, who is also behind ?Biggest Loser.?

Dr. Terry Schaack, medical director of the California Health Longevity Institute, where ?Extreme Makeover: Weight Loss? participants do an introductory ?boot camp,? says there can be a long delay between awareness and action.

?You will see nothing in national figures for probably eight to 10 years after a dramatic incident occurs,? he says. ?The U.S. Surgeon General went out and told people to quit smoking, I believe it was in ?67. A hoard of people quit smoking, and the incidence of heart disease went down 15 or 20 years later. It takes that long.?

In the meantime, in addition to ?The Biggest Loser,? an ample array of weight-loss shows should offer plenty of inspiration to Americans trying to slim down:

The CW?s ?Shedding for the Wedding? features overweight couples competing in weight-loss challenges to earn elements of their dream wedding. Oxygen?s ?Dance You?re A(asterisk)(asterisk) Off? scores plus-sized participants on their dance abilities and pounds lost. Lifetime?s ?DietTribe? tracked the weight-loss progress of five real women over four months of intense diet and exercise. The Style Network has ?Ruby,? a series that follows its morbidly obese namesake star on her journey to regain her health. There?s also MTV?s ?I Used to Be Fat,? Discovery?s ?One Big Happy Family? and ?AE?s ?Heavy.?

Two more weight-related series premiere this week: Lifetime?s ?Love Handles,? featuring overweight couples working to heal their relationships as they shed pounds; and ABC?s new ?Extreme Makeover: Weight Loss Edition,? which follows one super-obese subject each week and tracks that person?s weight-loss progress over one year during each hour-long episode.

Yet even as the number of weight-loss shows continues to expand, so does the nation?s waistline. More than 72 million Americans are considered obese and millions more are overweight.

Still, the health and fitness industry continues to flourish: Dietary Supplements bring in $26.9 billion annually, health clubs generate $24.8 billion a year, weight-loss centers take in $3.9 billion in revenue annually ? and all are poised to grow. But industry-watchers say this has nothing to do with weight-related reality shows.

?Fitness shows are not driving the trends in fitness, but more grabbing onto the coattails of the success of the fitness industry,? says Taylor Hamilton, an analyst with IBIS World. He attributes the growth in gym locations and memberships to an increased overall emphasis on fitness nationwide.

Shaack and dietician Paulette Lambert, who is featured on ?Extreme Makeover: Weight Loss Edition,? say they wish these shows offered more ?teachable moments? for viewers. The format of ?Makeover? lends itself to such moments, they say, since it isn?t a competition such as ?Biggest Loser.?

Each ?Makeover? episode follows only one person, and they aren?t taken away to a ranch: The super-obese subjects aim to shed about half their body weight in a year through diet and exercise while still living at home.

?You?ve got to prove you can do it on your own, in the same environment that got you fat,? Roth says. ?The stakes are real. The stakes are life. It?s not a million dollars or some contrived prize.?

?Makeover? participants first spend a week at the California Health Longevity Institute, a state-of-the-art facility that blends medical support with cooking classes, fitness training, healing arts such as hypnosis and spa treatments. They?re led by Chris Powell, an Arizona-based trainer best known for helping 650-pound David Smith drop more than 400 pounds naturally.

His main focus with clients? Overcoming past emotional trauma and rebuilding their personal integrity and sense of self-worth.

?Until that, it?s just weight loss that?s being forced,? says the 33-year-old Powell. ?Until they deal with those emotions, it will never stick.?

The subjects are shown facing setbacks and the emotional roadblocks that contribute to their dangerously overweight condition. After building trust one on one, Powell persuades participants to bare their souls on camera, telling them, ?There are so many people that are suffering just like you.?

Roth says he created ?Biggest Loser? because he is fascinated with human transformation, and he created ?Makeover? to help those who are too heavy to qualify for ?Loser.?

?My focus is to tell their story and to help them change their life,? Roth says. ?If they change their life, the audience watches and the ratings are high.?

Bariatric surgeon Ted Khalili, founder of the Khalili Center in Beverly Hills, says that while many of his patients are fans of weight-loss reality shows, he isn?t.

?Obesity is an epidemic and these shows are trivializing it,? he says, noting that the diet and exercise plans are often extreme and unsustainable. Still, Khalili says his patients can take some eating and exercise tips from these popular programs.

Jackie Smith of Los Angeles has been a fan of ?The Biggest Loser? since the beginning. The 47-year-old computer consultant says she has struggled with her weight all her life, and she?s dropped about 60 pounds in recent years through tips she?s taken from the show.

?It inspires me to do the right thing: Eat right, exercise,? she says. ?It motivates me to see them overcome the challenges, because if they can do it, I?m sure I certainly can.?

Seeing oversized contestants on the show also motivates her: ?Don?t get like that. That?s got to be so miserable.?

Jaci Koloars of Omaha, Neb., also loves watching ?Loser.? The 32-year-old has always been active and isn?t overweight, but she enjoys seeing the contestants transform their lives and bodies.

?My mom is overweight, so it kind of speaks to me in that way,? she says. ?I love seeing the health improvements they make, how much their lives change for the better, how their self-esteem increases. I would love to see that in my family.?

Besides a $50 million market of meals, DVDs and other weight-loss products, ?Loser? has also inspired an online community of show fans who are trying to lose weight themselves. ?Makeover? will also include a web component with free tips and recipes for viewers.

?I really see the winners of our show as being the people who watch our show ? It inspires them to keep going or it inspires them to start,? says ?Loser? trainer Bob Harper, who recently introduced his own line of weight-loss supplements.

?It?s sort of the tonic to make you look inward at yourself ? that?s what all these shows do,? he says. ?If we make someone look at their own life, and it?s not even weight-related but it?s something else they want to change in their life, to me that?s the best rating of all.?

Courtney Love Libels Her Ex-Lawyer on Twitter | Criminal Law News Now

For the second time, a Courtney Love Twitter defamation case is making waves. Ex-lawyer Rhonda Holmes alleges that the latest Courtney Love's libel tweets?have hurt her professional reputation and have caused her economic injury.

Holmes, a San Diego attorney, was originally retained as counsel for Love in a lawsuit where she was trying to pursue money stolen from the estate of Kurt Cobain, reports The Hollywood Reporter.

Love had fired Holmes' firm (Gordon & Holmes) after they had only agreed to represent Love in the legal action if she could remain sober the entire time. When she tried to re-hire them, they declined, according to The Hollywood Reporter. And so began the alleged Twitter defamation.

Likely unhappy with the rebuff she got from her former attorneys, Love tweeted "I was f****** devastated when Rhonda J Holmes Esq of San Diego was bought off." In a separate interview, Love had also stated that Holmes "disappeared" and couldn't be contacted since someone "got to her" and told her not to represent Love.

This Twitter defamation lawsuit is the second Twitter lawsuit for Love - she just recently settled for $430,000 on allegations that she defamed a fashion designer through a tweet.

The basics of defamation law, or libel (written defamation), is nuanced. It requires that plaintiffs must show that a statement was made, the statement was published, the statement then caused injury, and that it was a false statement. Also, the statement must not be "privileged" - such as a testimony at trial.

In Love's case, a Twitter post is most likely to be deemed a publication. And, Gordon & Holmes is claiming that they suffered injury, because their reputation and their business were subsequently hit after Love tweeted the post that suggested they had been bribed. And, the statement must be false - if what Love said is true, there was no defamation.

The Courtney Love Twitter cases keep coming, fast and furious. For Courtney Love, libel and Twitter seem to be two things that she mixes all-too often in those 140 character tweets.
