Case after case is reported daily concerning treatment of the elderly. Placing a person in assisted living or nursing care facilities often becomes a necessity when the elderly one can no longer care for themselves. Elder law and reform laws are enacted to keep the one that cannot care for themselves safe from all harm as they live out their final years. Often times an elder law lawyer may have to be contacted due to incidents that take place in the facilities with employees skilled to give that care.
Elder law is to ensure that the elderly will be taken care of, and if at all possible not be harmed. Twenty three years ago the Fed nursing home reform bill passed in hopes of protecting those who cannot protect themselves. However, elder law lawyers are often contacted by family members who suspect their loved one has been mistreated.
The elderly often have difficulty expressing themselves or cannot speak at all about the abuse they may be receiving. In that case it is left up to the family to determine if the bruises were due to a fall, or if their loved one is suffering malnutrition, or has fallen several times and perhaps has head injuries or broken bones.
Case after case has been reported against nursing facilities due to abuse against the residents. Sexual abuse is an on going matter that has gotten worse in the last decade. Physical and emotional abuse are also prevalent in the homes as well psychological and emotional mistreatment. No one likes to think their parents are being mistreated to that degree, but it happens very often.
In some cases home health aides are the abusers. Intrusting a certified person to go into the elders home and care for them, often gives the caregiver a greater opportunity to become to acquainted with the home and the resident they are to be caring for. Stealing is not uncommon when a home health aide has full access to every thing in the home.
Home health aides are not exempt from abuse. They often have full run of the home and take items that does not belong to them. They at times have been reported for not allotting the care they have been hired to do. Skipping meals or bathing the patient is two major complaints.
An organization known as the Ombudsman are a group that protect the rights of residents while living in a nursing home. Usually, the representatives make surprise visits and check out the living conditions, cleanliness and many other check list items. They can also be notified if there is suspicion of mistreatment. They in turn will notify either the police or an attorney if they feel it necessary.
Elder law lawyers are working diligently to change the present system, but it takes time and cooperation from all involved. Until then the elder law remains the same. Visiting the patient as often as possible, and examining them for bruises or any sign on their body that is out of the norm is very important. The elderly are very vulnerable to abuse, and often suffer at the hands of the ones suppose to be giving them excellent care. The elder becomes dependant on the workers of the home, and are afraid to speak out for fear of being removed from a setting they have grown accustomed to.
