Who Really Owns the iPad Trademark in China?

The hearing that could determine ownership of the iPad trademark in China kicked off this morning with a broad rehash of the battle we?ve seen play out in the media the past few weeks: Apple arguing it Proview Technology?s worldwide rights to the iPad trademark several years ago, and Proview claiming it bought them from an affiliate that didn?t own them.

?Apple meticulously formed a band of lawyers to buy the trademark, but the transacted amount was given to Taiwan?s Proview, not Shenzhen?s Proview,? Proview?s attorneys told the court, adding that the iPad trademark therefore still belongs to Proview?s Shenzhen unit, its claimed original owner.

The problem with that argument, as Apple?s legal team was quick to point out, is that negotiations over the iPad trademark were authorized by Rowell Yang, chairman of Proview Shenzhen, and the actual transfer agreement was signed by Ray Mai, head of Shenzhen?s legal department.

Proview?s explanation for this according to its lawyers: ?Personnel may have multiple roles or titles within the group, but the question is in what capacity were they acting??

And that really gets to the heart of the issue here: Did Apple buy the iPad China trademark from a company that didn?t own it?

?The ownership of the trademark when it was allegedly sold is not really in doubt; it was owned by Proview-Taiwan,? Dan Harris, an intellectual property attorney at Harris & Moure, explains. ?The real question is whether Proview-Shenzhen authorized Proview-Taiwan to sell the iPad trademark to Apple.?

Because if it is determined that it didn?t, Apple is in quite a bind. ?The value of iPad?s trademark rocketed after Apple launched the tablet computer in January 2010,? the company?s legal team told the court. ?In the eyes of the consumer, iPad is associated with Apple. If the court decides that Proview wins the case, then this will confuse consumers and hurt their interests.?

And it will force Apple to negotatiate a new deal with its cash-strapped opponent, undoubtedly a very expensive one.

Which is exactly what Proview is seeking here.

Said Proview attorney Xiao Caiyuan, ?Apple wants to legally obtain permission to use the trademark, or to own the trademark by legal transfer, and it can provide a basket of proposals on settling the case outside of court, we would not refuse it.?

Student Affairs - the First Years: Why Can't We Be Friends ?


I had a difficult time coming up with ideas for this blog so I asked a coworker for ideas. She suggested that I write about my awesome coworkers so I started thinking about all of the friendships/relationships I?ve made within Student Affairs.? First of all, I have amazing coworkers.? When I first started this position, I was very nervous about fitting in and making connections with the people around me.? I had just come from a position where I had strong relationships with my supervisor and colleagues.? I was worried that I wouldn?t have the same experience in this new position. However, I was pleasantly surprised.? The individuals I currently work with are so helpful and supportive.? On my first day, I was welcomed with open arms and was treated with respect. I was never treated like ?the new person?. From the beginning, I was a part of the team and given the same opportunities as the rest of my colleagues. ??I learn from them on a daily basis and they have become not only coworkers but friends.? I am so fortune and thankful for the people around me.? I hope all of the lovely readers have similar experiences with your coworkers- if not, I hope that changes in the future!

Some of my coworkers and I have shared laughter and fun outside of work as well. This has helped us bond and develop friendships. ?Some of the people I work with tried to teach others how to crochet (and it is harder than it looks).? Although I was unsuccessful, it had turned into a hobby for others. It was fun spending time with people outside of work and learning something crafty.? We have designated ?girls? nights? and hope to continue these in the months ahead. ?Whether it is trying new restaurants, going to sporting events (even if they are rooting for the other team), or having a spa day spending time with coworkers/friends is fabulous.? ?

Not only am I appreciative for the people in my current job, but I am also grateful for the people I have worked with in the past.? My former coworkers in the Financial Aid Office at Ball State University and my cohort in the Student Affairs Administration in Higher Education (SAAHE) are people that I have built long lasting friendships and connections.? I think within the world of Student Affairs, you build these connections that transcend time.? You know that you can turn to a colleague that you have lost connection with and feel confident he or she will remember you and provide you with guidance or support.? That is just how we operate- we are folks who love to help others.? With NASPA quickly approaching (14 days? ) I am so excited to make new connections and catch up with others who have been off of my radar.? I like to think of NASPA as a big family reunion- we can have fun but still share knowledge and appreciation of the field together.? EdTech 20/20 Blog: Home Self Improvement (Unschooling our kids)

This post is not the beginning of my thinking on the topic, but it is the first time I've tried to articulate these thoughts into writing.? I beg you to forgive the rough edges.

Seth Godin just published his Stop Stealing Dreams education "manifesto."


I've read many, but not all, of the books that he references.? His manifesto and those foundational books resonate with me.? I have verbalized for the last four years that as a middle school teacher "I am part of the problem," but it's only in the last four months that I have some inkling of how to maybe actually change that status.?

I've taught for 14 years, mostly in the secondary level in the USA.? I'm part of an institution that is meant to do good and is staffed almost universally by good people wanting to do good.? And yet we do not do the good we mean to do (o wretched man that I am--who will deliver me?) and instead institutionalize obedience when what we wanted to do all along was to develop capacity and foster creativity.

My daughter and two boys are in currently in elementary school, and we their parents are grateful for their traditional classrooms, complete with its peer interactions (both the friendships and the dramas), recess, monkeybars, cafeteria food, spelling bee, penalties for late work, reward systems, science projects, and occasional homework.? I'm glad they are in elementary school and wouldn't have wanted to do those ages any other way.

Middle school looms.? My daughter is a 5th grader in a K-5 school and next year would go to a local middle school.? Now, my daughter is not yet a teenager and while we certainly hope for the best for her, middle school looms.? What a toxic environment to place the most emotionally fragile humans in our society.? Honestly, who would have invented, in this modern era, a plan that takes 500 of a town's middle schoolers to a central building and causes them to sit in clumps of 30 until a bell rings to signal that they should stand up en masse, jostle in the halls, and return to a different classroom of rows and columns for another hour of trying not to pay attention to the leader in the classroom?? Nobody would have thought that's a good idea if it hadn't already been that way when we found it.?

I believe adolescence is an artificially created "age" that is caused by society withholding responsibility from its emerging adults until too late. And yet, pubescent hormones are very real, and pre-teen turmoils are rarely avoided altogether.? There's something important there, though I really don't yet know what it is.? Something about adolescence not being in a causal relationship with pubescence.? Interesting to think more on.

We're the lucky ones, my family.? We live within the means of a one-salary home, and so we have the freedom to have our daughter at home with us next year rather than send her off to the middle school.? Does that mean we're going to home school?? No, I don't think so.? More like unschool, though I may be muddled in my terminology.? We're calling it HSI, Home Self Improvement.


Home Self Improvement:? Creative.? Capacity-building.? Exploratory.?
Foreign languages, math, geography, drawing, writing, typing, cooking, and EXTENSIVE reading.? In the reading category alone: biographies, historical fiction, science, Newberry Award winners.? Also TED Talks as jumping-off places for student-led research and discovery.

Is HSI going to be "school" for the Chase kids only until high school, or is this it through college?? I don't know.? The local high school has a fantastic DECA/FBLA club, and I'd love to have my kids get to do drama, culinary classes, and the upper level maths/sciences/humanities with engaged teachers and leaning-forward peers.? Can you imagine what their school experience would be if they could "skip" all the classes where peers don't want to be there--I'm thinking of my freshman health class as I write--and go right to the ones that are upper-level and not "required."? It's in those academic classes that you'll find kids leaning forward, and it's those classes that I'm excited to help my kids prepare themselves for.? The other credits they'll still have to get, but they can get them online.

I want each kid to come out of HSI a sleek, powerful racehorse of a person, not a fat little pony.

Design Darling: Surprise Launch Party

Let me just start this post by saying that I am blessed to have the most wonderfully supportive family and friends in the world. I came home from a weekend trip to a friend's lake house to a room full of people yelling, "Surprise!" My cousin Emily and the rest of my family had planned a surprise launch party for the boutique ? and somehow I really had no idea!Emily gathered ideas from her Pinterest to plan the decor and food. Of course she thought of literally everything! The navy and pink palette was right up my alley and she divided the table with breakfast on one side and lunch on the other. I think I ate about 58?ten?bruschetta. So good!?

The house was filled with flowers which is of course the most wonderful treat. My grandmother ? who is quite possibly Design Darling's number one fan! ? send this beautiful bouquet up from Florida.

Emily thought of every last detail right down to filling the candy bowls placed throughout the family room and kitchen. Did you know Party City now sells M&Ms by the color? This makes me endlessly happy.

Of course the biggest gift was everyone who came out to celebrate this new venture of mine. My aunt was visiting from Boston and my sister even drove down from Amherst for the occasion! Family, friends, flowers... I am the luckiest girl in the world!

And the pi?ce de r?sistance... The cake that my cousin and her friend made after my logo, illustrated by Gadabout. Apparently it took them three hours to get the colors just perfect. Aren't the bows just the sweetest touch?

Rethinking the social structure of ancient Eurasian nomads

Prehistoric Eurasian nomads are commonly perceived as horse riding bandits who utilized their mobility and military skill to antagonize ancient civilizations such as the Chinese, Persians, and Greeks. Although some historical accounts may support this view, a new article by Dr. Michael Frachetti (Washington University, St. Louis) illustrates a considerably different image of prehistoric pastoralist societies and their impact on world civilizations more than 5000 years ago.

In the article, recently published in the February issue of Current Anthropology, Frachetti argues that early pastoral nomads grew distinct economies across the steppes and mountains of Eurasia and triggered the formation of some the earliest and most extensive networks of interaction in prehistory. The model for this unique form of interaction, which Frachetti calls "nonuniform" institutional complexity, describes how discrete institutions among small-scale societies significantly impact the evolution of wider-scale political economies and shape the growth of great empires or states.

Around 3500 BC, regionally distinct herding economies were found across the Eurasian steppes. In some regions, these societies were the first to domesticate and ride horses. Over the next 2000 years, key innovations introduced by steppe nomads such as chariots, domesticated horses, and advanced bronze metallurgy spread across the mountains and deserts of Inner Asia and influenced the political and economic character of ancient civilizations from China to Mesopotamia, Iran, and the Indus Valley.

Although the mobile societies that fueled these networks came to share certain ideological and economic institutions, in many cases their political organization remained autonomous and idiosyncratic. Still, these regional economic and social ties forged between neighboring mobile communities helped new ideologies and institutions propagate over vast territories, millennia before the fabled "Silk Road."

Community Kitchen: White Stone Bistro: A happy discovery

I knew I would like White Stone Bistro from the moment I spoke to chef/owner Regina Lorenz on the phone. I sensed from her voice that the restaurant would be a warm and hospitable place, and when Gordy and I arrived in the town of Rich Fountain (an hour?s drive south of Columbia) on a bitterly cold night and entered the coat room of the tiny bistro, my instinct about it was confirmed. Regina?s husband, Bob, took our coats and ushered us into the dining room where just four tables?two large and two small--filled the space. The restaurant is housed in what used to be the wine cellar of an old general store. Its low ceiling, warm wood, and stone walls make for a cozy atmosphere, which is only improved by the kindness of the proprietors. Regina cooked, Bob took our orders, and Tracy, Regina?s daughter, split her time between the kitchen and the dining room. All three came around to talk with us at various points during the meal.

In my mind, the intimacy and simplicity of the restaurant?s operation is one of its greatest charms. Guests must call ahead for reservations because the seating is limited and the restaurant is only open on Friday and Saturday nights. The menu also shares in this scaled-down approach. The dinner selections change weekly, dependent on the availability of fresh ingredients, and consist of two appetizers, four main dishes, and two desserts. (The restaurant also offers a good wine and beer list.)

When we visited, we chose crostini with herb-crusted ch?vre from Goatsbeard Farm as our appetizer?although I was also quite tempted by the other offering, ravioli that Bob makes by hand. We considered our next course while nibbling on the crostini. Each entr?e comes with warm homemade bread, the sides of the week, and a salad course. Surprisingly, among the meal?s highlights were the salad dressings?also made in-house. Gordy ordered his favorite, blue cheese; Regina?s is particularly rich and flavorful, made from a Goatsbeard Farm blue. On Bob?s suggestion, I ordered the celery seed dressing, which has a lighter, slightly sweet flavor and is absolutely delicious.

Our main courses, whose accompanying sides were roasted potatoes and green beans, were simple but well-prepared. I had the saut?ed shrimp, and Gordy had the Kansas City strip steak. Meats, we learned, are Regina?s specialty; while my shrimp were very good, Gordy?s steak was a dream: juicy and tender with just the right amount of flavorful crust seared into it.

It must have been my state of after-dinner bliss--and most of a bottle of good red wine--that induced me, despite the fact that I was quite full, to order both the rich, chocolate ganache cake and the carrot cake for dessert. Both cakes were dense and moist and delicious, and despite our fullness, both somehow disappeared from their plates. Along with the dessert, Bob brought us complementary glasses of sherry and homemade limoncello--and a small bowl of Regina?s homemade granola, just so we could taste it.

When Regina asked how we had heard of White Stone, I was surprised that she clearly remembered my friends who had recommended the restaurant to us?not only their names, but also where they lived and what they did for work. After dinner, she addressed Gordy and I by name, gave us big hugs and told us to come back. I left White Stone Bistro feeling fuller than I?d been in a long time. I don?t mean only that my belly was full, but also that I was filled with a sense of well-being, a feeling that usually comes upon me only after a restful time spent with family or very dear friends.

NASA pinning down where 'here' is better than ever

ScienceDaily (Feb. 24, 2012) ? Before our Global Positioning System (GPS) navigation devices can tell us where we are, the satellites that make up the GPS need to know exactly where they are. For that, they rely on a network of sites that serve as "you are here" signs planted throughout the world. The catch is, the sites don't sit still because they're on a planet that isn't at rest, yet modern measurements require more and more accuracy in pinpointing where "here" is.

To meet this need, NASA is helping to lead an international effort to upgrade the four systems that supply this crucial location information. NASA's initiative is run by Goddard Space Flight Center in Greenbelt, Md., where the next generation of two of these systems is being developed and built. And Goddard, in partnership with NASA's Jet Propulsion Laboratory in Pasadena, Calif., is bringing all four systems together in a state-of-the-art ground station.

"NASA and its sister agencies around the world are making major investments in new stations or upgrading existing stations to provide a network that will benefit the global community for years to come," says John LaBrecque, Earth Surface and Interior Program Officer at NASA Headquarters.

GPS won't be the only beneficiary of the improvements. All observations of Earth from space -- whether it's to measure how far earthquakes shift the land, map the world's ice sheets, watch the global mean sea level creep up or monitor the devastating reach of droughts and floods -- depend the International Terrestrial Reference Frame, which is determined by data from this network of designated sites.

Shapeshifting

Earth is a shapeshifter. Land rises and sinks. The continents move. The balance of the atmosphere shifts over time, and so does the balance of the oceans. All of this tweaks Earth's shape, orientation in space and center of mass, the point deep inside the planet that everything rotates around. The changes show up in Earth's gravity field and literally slow down or speed up the planet's rotation.

"In practical terms, we can't determine a location today and expect it to be good enough tomorrow -- and especially not next year," says Herbert Frey, the head of the Planetary Geodynamics Laboratory at Goddard and a member of the Space Geodesy Project team.

Measuring such properties of Earth is the realm of geodesy, a time-honored science that dates back to the Greek scholar Eratosthenes, who achieved a surprisingly accurate estimate of the distance around Earth by using basic geometry.

Around 240 BC, Eratosthenes found that when the sun sat directly above the Nile River town of Syene, it shone an angle of 7.2 degrees (1/50 of a circle) in the northern city of Alexandria. Reasoning that the distance from Alexandria to Syene was 1/50 of the way around the globe, he came up with a circumference of roughly 25,000 miles for Earth, quite close to the modern measurement of 24,902 miles.

"Even with the sophisticated tools we have now, geodesy is still all about geometry," says Frank Lemoine, a Goddard geophysicist on the project.

Team geodesy

As in ancient Greece, geodesy today is a team sport, relying on observations conducted in multiple places. Over the years, four types of space geodesy measurements, carried out by a squad of ground stations and satellites, developed independently. Together, they tell the story of what's happening on Earth and keep track of the Terrestrial Reference Frame.

"While there is some overlap in what can be gleaned from each geodetic technique, they also provide different forms of information based on how they operate," says Jet Propulsion Laboratory's David Stowers, who manages the hardware and data flow for the GPS portion of the space geodesy initiative. "GPS was designed specifically as a positioning system and is fairly ubiquitous, thus providing data strength in numbers. It is unique in providing a physical point of reference for the Terrestrial Reference Frame, with the position of the GPS antenna as the primary type of data."

Another technique, Very Long Baseline Interferometry (VLBI), acts as a kind of GPS for Earth. To deduce Earth's orientation in space, and the small variations in Earth's rate of rotation, ground stations spread across the globe observe dozens of quasars, which are distant enough to be stable reference points.

"VLBI is the one technique that connects measurements made on Earth to the celestial reference frame -- that is, the rest of the universe," says Stephen Merkowitz, who is the project manager for NASA's space geodesy initiative.

The key is the painstakingly accurate timing of when the quasar signals arrive. "With this information, we can determine the geometry of the stations that made the observations," says Chopo Ma, head of the VLBI program at Goddard.

By knowing the geometry, researchers aim to measure the distances between the ground stations down to the millimeter, or about the thickness of a penny.

Keeping tabs on Earth's center of mass is the job of satellite laser ranging (SLR). It measures the distances to orbiting satellites by shooting short pulses of laser light at satellites and measuring the time it takes for the light to complete the round trip back to the ground station.

"SLR tells us where the center of mass is, because satellites always orbit around the planet's center of mass," says Lemoine.

Another way to measure distances to satellites is with DORIS (Doppler Orbitography and Radiopositioning Integrated by Satellite), which was built and is operated by the French space agency, known as CNES.

DORIS takes advantage of the Doppler effect, which is at work when an ambulance's siren changes pitch as it's driving toward or away from you. The same effect retunes the frequency of a radio signal emitted by a DORIS beacon as the signal travels from the ground into space and is received by a satellite orbiting Earth. By measuring the frequency change, researchers can work backward to figure out the distance from the beacon to the satellite that picked it up.

Like GPS, DORIS requires little hardware on the ground, so its beacons are spread all over the globe, even in areas as remote as the Mount Everest base camp.

Coming together

All ground stations were not created equal. Some sites are home to one technique, others to two or three, and the sophistication of the techniques can vary from station to station. Right now, only Goddard and the station in Johannesburg, South Africa, are providing results from all four. NASA wants to change that.

"The plan for the upgraded system is to have at least three, and preferably all four, techniques at every station," says LaBrecque. "This is one of the keys to achieving the goals of a millimeter of accuracy and a tenth of a millimeter of stability for future measurements."

At the Goddard Geophysical and Astronomical Observatory (GGAO) in Greenbelt, Md., where the state-of-the-art prototype station is being developed, a new VLBI antenna was just installed. Capable of moving faster than its predecessors, the antenna will complete more observations during a run. It's the first piece of a completely revamped VLBI system that will be more sensitive yet less prone to interference from things like cell phones.

The Next Generation SLR is also being developed at GGAO, under the direction of Jan McGarry, with the goals of more automated operation and the ability to target satellites in higher orbits. Already operational for selected tasks, the system has been ranging to NASA's Lunar Reconnaissance Orbiter since June 2009.

Another key innovation at Goddard's new station is the "vector tie" system that will link together all four measurement techniques. "Right now, we have these four independent techniques, and they're just that: independent," Lemoine says. "Presently, at a particular ground station, the techniques are only tied together by expensive and infrequently performed ground surveys."

But with the vector tie system, which will use a laser to continuously monitor the reference points of each technique, researchers will know exactly where a station's GPS, VLBI, SLR and DORIS sit relative to each other at all times, allowing them to better correct one of the last sources of error in the terrestrial reference frame.

Between 25 and 40 upgraded stations would need to be deployed worldwide the complete the new network. The importance of this investment is detailed in the report "Precise Geodetic Infrastructure: National Requirements for a Shared Resource" by the National Research Council of the National Academies in Washington, D.C.

Agencies around the world, including Germany's Bundesamt f?r Kartographie und Geod?sie, France's Institut G?ographique National, the Geographical Survey Institute of Japan, and Geoscience Australia, would build the stations. Together, these groups would choose the best locations, and the work would be done in cooperation with the Global Geodetic Observing System, a scientific organization that helps maintain the terrestrial reference frame.

"By bringing at least three of the four techniques together in each station, we will get a stronger system overall," says Frey. "NASA is leading the way in this, building a prototype station that will go beyond our current scientific requirements and serve the satellites of the future."

Man Sentenced For Cocaine Trafficking From Mexico To 4 States

ALEXANDRIA, Va. (WUSA) -- A 29-year-old man from Texas has been sentenced to more than 19 years? for leading a cocaine trafficking conspiracy that funneled illegal drugs from Mexico to Texas, Arkansas, Virginia and Pennsylvania, according to the United States Attorney for the Eastern District Of Virginia.

Jorge Gutierrez of Austin, Texas?will serve 235 months in prison, followed by five years of supervised release.

Gutierrez was among 15?people indicted on June 4, 2010 for conspiracy to distribute five kilograms or more of cocaine. All 15 have been convicted.

According to court records, Gutierrez led the cocaine trafficking ring from December 2009 to June 2010. He went to Mexico, purchased cocaine, and then arranged to transport the cocaine to his home in Austin. Gutierrez was also responsible for coordinating the transport of drug proceeds after the sale of cocaine in Virginia. Gutierrez had his co-conspirators deliver the cocaine from?Texas?in vehicles to Arkansas, Virginia and Pennsylvania.?

Approximately 60 kilograms of cocaine were transported into Virginia during six months.
